Erie County DA issues comment on Tyler Lewis

Erie County District Attorney John J. Flynn issued these comments Friday on the investigation into the fatal stabbing of Tyler Lewis:

“Since Oct. 14, 2022, our investigation into the fatal stabbing of Tyler X. Lewis has remained a top priority for my office, our partners in law enforcement and the University at Buffalo. While I understand that his family has waited six months for answers, it was important that we conduct a complete and thorough investigation into the events that led to Tyler’s untimely death in order to present all of the evidence to a grand jury.

“Today, the grand jury issued a no bill of indictment, finding that there was no probable cause to charge anyone with a crime that could be proven beyond a reasonable doubt in a court of law.

“In addition, my office spoke with the attorney who represents the Lewis family to provide a full understanding of our investigation into his tragic death and the decision of the grand jury.

“The grand jury is an independent investigative body comprised of citizens of Erie County. As it is a secret proceeding held in private, our office is prohibited from disclosing when a grand jury investigation is underway. While I recognize the importance of transparency in this case for Tyler’s family, University at Buffalo and SUNY Buffalo State University communities, as well as the public, our office cannot disclose any evidence or witness testimony that may have been presented before the grand jury.

“As I have stated before, our office provided consistent updates to the Lewis family throughout this extensive investigation. While I understand that the family is seeking an arrest in this case, I stand by the decision of the grand jury.

“Tyler’s family and friends remain in my thoughts and prayers as they continue to grieve during this difficult time.”

University at Buffalo Response

“During the many months of this investigation, we extend our appreciation to our law enforcement partners from across the region for their assistance during this comprehensive investigation, including the Office of the Erie County District Attorney, New York State Police, the Federal Bureau of Investigation, Town of Amherst Police and Erie County Central Police Services,” said Chris Bartolomei, UB chief of police. “To Tyler’s family and friends: The investigators, officers and staff within the University Police continue to extend their sincerest condolences.”

During Friday’s briefing, Flynn mentioned the involvement of a UB student who was a friend of the victim. That individual is no longer a student at UB. 

University Police would also like to acknowledge the admirable actions of a UB resident assistant (RA) who quickly called for assistance on Oct. 14, 2022, ensuring the prompt arrival of UB Police to the scene — one minute after the call to dispatch — where officers provided first aid and CPR until EMS arrived 11 minutes after the RA’s initial call.

University Police will have no further comment on the case.
