USACE Buffalo provides guidance on permits needed for shoreline work performed along Lake Erie

Thu, Jun 7th 2018 11:55 am
The U.S. Army Corps of Engineers, Buffalo District, urges the public with properties along Lake Erie to contact USACE's regulatory branch at 716-879-4330 or visit online at http://www.lrb.usace.army.mil/Missions/Regulatory.aspx to ensure proper permits are in order for any existing or planned shoreline alterations.
A Section 10 Rivers and Harbors Act permit and/or Section 404 Clean Water Act permit are required for any work in, over, and/or under a navigable water, such as Lake Erie.
A federal permit from the USACE may be required even if state authorization has already been granted.
USACE is issuing this guidance due to the above-average high lake levels and strong northeast winds this spring, which has prompted an uptick in phone calls from the public regarding shoreline protection measures people wish to implement.
USACE has also fielded increased calls reporting alleged violations of permit requirements; such concerns are reportable through the USACE website, as well.
