Town of Niagara Planning Board tables discussion on Bri Estates

Board tentatively schedules special meeting

On Tuesday evening at the Town of Niagara Town Hall, the Town Planning Board held its monthly meeting. Discussion on the revised Bri Estates site plan was expected, but the board had to table all discussion after developers from Double C Realty felt the need to make changes to their plan and submit an updated proposal. Planning Board members agreed they didn't know what changes would be made to the proposal.
The Bri Estates proposed development would place over 100 homes behind residents of Colonial Drive and Miller Road.
In attendance was municipal attorney Corey Auerbach, who has had experience assisting the Planning Board. Auerbach recently met with the Bri Estates developers and from the meeting he said, "The Building Inspector Mr. (Charles) Haseley suggested that there were certain additional waivers and variances that would be required as part of the development process that the applicant had not yet requested from this board.
"So, after that meeting, it was my suggestion that to the extent there are waivers or variances that have been identified that they have not formally requested yet from the board, because their request from waivers and variances really is part of the preliminary application. They needed to formalize those based upon Mr. Haseley's comment, so that there's a complete record upon the Planning Board as to exactly what is being requested."
Auerbach also suggested the developer's counsel be prepared to present each of the waivers and variances to the board in detail to help not just the Planning Board, but the public, as well.
After Auerbach's statement, the Planning Board discussed holding a special meeting to hear about the changes, similar to a Town Board work session. Auerbach said he believed the developers would submit the changes within a week or two, and wouldn't wait around until the 10-day deadline before the June 5 Planning Board meeting.
In turn, the Planning Board decided to tentatively schedule a meeting to hear from the developers at Town Hall at 7 p.m., Wednesday, May 23. The board said if they didn't receive the submittal changes prior to Friday, May 18, the meeting would likely be cancelled.
