In the mounds of paperwork accompanying legal counsels for developer Jerome Williams and Lewiston Management Group LLC (the plaintiffs), Whirlpool Jet Boat Tours and the Village of Lewiston (the defendants), one tiny bit of information was missing Thursday in State Supreme Court: the original argument bringing the opposing sides before Justice Richard C. Kloch Sr. Without an attachment of complaint in a motion to dismiss, Kloch said, "I cannot do what I would love to do," and that is shelve Williams' case, which alleges the village violated the public trust doctrine.
The plaintiff contends the village's 2002 lease with the tourism company is contrary to the required usage of the waterfront land's easement, which is for the public benefit as a public recreation area.

The Village of Lewiston received new drawings Tuesday from the principals behind the Frontier House on Center Street. Attorney John Bartolomei, E.I. Team President Hormoz Mansouri and developer Richard Hastings seek to refurbish the historic Center Street building and construct a new, four-story building over what is now the Frontier House parking lot. The drawings, which were left for the Planning Board to review prior to its Monday meeting, indicate the following:

The Barton Hill Hotel & Spa reopened Monday, exactly two weeks after a small fire damaged the inside of a first floor room. The 14-day turnaround was the result of required safety checks and maintenance. The hotel's spa services resumed on Saturday.

A controversial land transfer in the Village of Lewiston was not unconstitutional.
So said State Supreme Court Justice Richard C. Kloch Sr. on Thursday, as he ruled in favor of the municipality and its deeding over of 197.23 feet of Water Street property to Whirlpool Jet Boat Tours and its president, John Kinney, for $1. Kloch said the sale, coupled with potential insurance savings, was adequate consideration.

In the end, the Whirlpool Jet Boat Tours controversy boiled down to one thing and one thing only: a roughly 2,580-square-foot expansion. Despite the objections Monday night of a handful of people who claimed the tourism business is a bad neighbor, the Village of Lewiston Board of Trustees said the only issue members were interested in was the $1 million, two-story addition proposal that sat before them. Finding nothing wrong with the plan, the board approved it by a 4-0 measure.

While audience participation was significantly different than one month ago, the end result was the same. The Village of Lewiston Planning Board unanimously approved Whirlpool Jet Boat Tours' President John Kinney's request to build a two-story addition to the U.S. home of his binational company.

The Village of Lewiston Planning Board will have two Whirlpool Jet Boat Tours expansion designs to consider when it meets Monday at 6:30 p.m. in the Red Brick Municipal Building. WJBT President John Kinney, upon consultation with Silvestri Architects, commissioned a second plan that shows 10 feet shaved off the north side of his proposed development.
