AARP comments on nursing home immunity

AARP New York State Director Beth Finkel issued the following statement regarding nursing home immunity:

“Last week, New York state lawmakers took an important step toward partly remedying a wrong that slipped into the state budget in April. Lawmakers passed a bill to repeal legal immunity for nursing homes – but only for non-COVID-related care, and only going forward.

“But what happens to the more than 6,300 families in New York who lost a loved one to COVID-19 in a nursing home? And what about those who will lose loved ones in nursing homes to COVID in the future?

“What about the rights of these families?

“AARP is calling on Gov. Andrew Cuomo to sign the bill that is on his desk – on the condition that he finishes the job by repealing immunity fully and retroactively.

“AARP has fought for the rights of nursing home residents since our founding over 60 years ago to ensure their health, safety, quality of care, and quality of life. Gov. Cuomo, join us in this ongoing fight. You can make things right for the thousands of families who lost a loved one. In many cases, these residents died alone without the comfort of their family in their final moments. Do not cut these families off from their rights in the court system.”
