Change of venue granted in Quasar lawsuit

As of this morning, the Town of Wheatfield's request for a change of venue in a lawsuit brought by Quasar Energy Group subsidiary Sustainable BioElectric has been granted.

Town Attorney Bob O'Toole said the town received a letter from the court this morning granting the motion and moving the case to Niagara County. He estimated it might take about six weeks before the case is fully transferred.

The lawsuit was originally filed in November in Erie County over a biosolids law Wheatfield's Town Board passed in August. In the suit, Quasar argues the town did not follow proper procedure in establishing the law and that it violates rights granted by the state departments of environmental conservation and agriculture and markets.
