Lewiston resident Iver Phallen, wearing shackles on his wrists and ankles, appeared Tuesday evening before Lewiston Town Justice Hugh Gee. Phallen was arraigned on his Sept. 27 kidnapping sexual abuse arrest involving a Buffalo woman that thus far has led to a battery of felony and misdemeanor charges filed. Phallen, escorted by Lewiston Police and State Police, was joined by his attorney, James Grable Jr., and Niagara County District Attorney Holly Sloma. Gee ordered Phallen, who has been indicted by a grand jury, to refrain from any contact with the victim or her family. He remains incarcerated.
State Police Trooper Victor Morales and Lewiston Police have said the case remains under investigation with other individuals coming forward and additional charges possible. Phallen's case was moved to Niagara County Court where he awaits a Tuesday court appearance and an entering of a plea, followed by any setting of bail.
