2-vehicle crash leads to DWI arrest

Erie County Sheriff Timothy B. Howard reports the Crash Investigation Unit is investigating a two-vehicle crash that occurred Sept. 22 around just after midnight.

The sheriff's office said 25-year-old Nicholas A. Fachko from the Town of Grand Island was traveling eastbound on Whitehaven Road in a 2011 Subaru Impreza and crashed into the rear of a 2009 Ford Taurus driven by 23-year-old Andrew M. Mrzygut, also from Grand Island.

Twin City Ambulance took both subjects to Erie County Medical Center where Mrzygut was listed in critical condition and Fachko was treated and released.

Fachko was arrested for driving while intoxicated and refused a chemical blood test to determine his blood-alcohol content. He was issued a ticket to appear in Town of Grand Island Court, on Oct. 15, for arraignment.

Further charges are pending the outcome of the investigation.
